The U.S. Supreme Court is reviewing a decision in the case South Dakota v. Wayfair, Inc. South Dakota is asking SCOTUS to overrule itself in its 1992 precedent Quill v North Dakota which, according to Bloomberg, “prevents states from requiring remote sellers to collect use tax from customers in the state, unless the seller has a physical presence there.” An estimated $80 million dollars and the Governor’s so-called “Amazon Tax” are riding on the Supreme Court’s decision in the case. Vin Bonventre, Albany Law School Professor and New York Court Watcher blogger, founder and Editor of State Constitutional Commentary, explained the law; New Paltz Mayor Tim Rogers explained what its impact could be on localities.
